NOT GUILTY the Judge ruled on Thursday, February 26, 2009 after a trial in a case where the Montgomery County Police Alcohol Enforcement Unit brought charges against a 43 year old man and his adult son for “furnishing alcohol” to a minor. The police publicized the case as one of the first to be prosecuted under a new Maryland statute which carried enhanced penalties for subsequent offenders, however Rene Sandler, Esq. raised in court serious constitutional violations committed by the police in their charging process and during the underlying arrest of the two Defendants.
After the ruling, Sandler said, “The Court’s ruling reaffirms that the Constitution does in fact protect us and the police when charging a person with a crime must adhere to those protections afforded to us all.”
